What Was Your "Status" on the Premises?

Your case may depend in part your reason for being on the premises where you were injured. Here are the three levels of "status" for visitors:

  1. Invitees/business visitors: If the owner of the premises invited you to come, then he or she has the highest obligation to make sure that the premises are safe. This includes businesses that advertise for customers —such as grocery stores, department stores and restaurants.

  2. Licensees: Being a licensee means you have permission to enter the premises, but you don't have to be under the owner's supervision. Since the owner grants licensees a certain amount of responsibility, the level of liability is lower than for invitees.

  3. Trespassers: If you weren't invited (or even welcome) on the property where you were injured, then the law doesn't expect for the owner to keep the property in safe condition for you. However, if a property owner is aware of the trespasser, they may have some level of responsibility towards the trespasser.
