The Closing Process in South Carolina
Under South Carolina law, supervision by an attorney is required for:
- Certifying title to the property
- Preparing documents for transfer of deed
- Real estate closings
- Recording legal documents with the courthouse
Beyond these legal requirements, Tidelands Law can also negotiate and draft the real estate contract, write title insurance, and connect clients to a network of local mortgage lenders. Although we cannot ethically endorse a particular appraiser or home inspector, we often provide our out-of-state clients with a list of reputable professionals in the Georgetown area who can perform those services.
The Contract — We can represent clients in negotiating purchase price and other terms of the real estate contract (purchase agreement). If the buyer or a real estate agent prepared the contract, we review it to ensure your interests are protected, and suggest changes such as the seller's responsibility for correcting identified defects (e.g., moisture damage, roof repair).
Title Opinion — Mr. Perrow researches the history of the title to verify that there are no liens or defects. He also is an authorized title insurance agent.
Preparing the Deed — Your lawyer should be familiar with all state laws applying to transfer of ownership. For example, South Carolina does not recognize "tenancy by the entirety," thus requiring specific language in the deed to address conveyance to a spouse or heir in the event of death. South Carolina recognizes only mortgage contracts (no deed of trust to a third party).
Closings and Filings — Tidelands Law will hold your down payment in escrow until closing, provide the seller with your mortgage commitment, and review the HUD-1 disclosures. Your real estate closing ("settlement") is typically held at our Georgetown office. We oversee signatures and final disbursements, review all documents, and address any last-minute issues that arise. After closing, we register the deed with the county.
